General Terms and Conditions of O&one High Tech Solutions GmbH Informationssysteme
§1 Scope and Definitions
(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed (§ 13 BGB).
§2 Conclusion of Contract, Storage of Contract Text
(1) The following rules regarding the conclusion of the contract apply to orders placed via our online shop at http://www.cream-creator.de.
(2) In case a contract is concluded, the agreement is made with:

(3) The presentation of products in our online shop does not constitute a legally binding offer but a non-binding invitation for consumers to place an order. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.
(4) When an order is received in our online shop, the following rules apply:
The consumer submits a binding contractual offer by successfully completing the order process in our online shop.
The ordering process includes the following steps:

Review of the information in the shopping cart

Clicking the “Checkout” button

Logging into the online shop after registration and entering login details (email address and password)

Final review and correction of the entered data

Binding submission of the order by clicking the button “Place order with obligation to pay” or “Buy”
Before the binding submission, the consumer can return to the previous pages to correct data or cancel the order by closing the browser window.
We confirm the receipt of the order immediately with an automatically generated email (“Order Confirmation”). This confirmation also constitutes acceptance of the offer.
(5) Storage of the contract text for orders via our online shop: We store the contract text and send you the order data and our Terms and Conditions by email. You can view the Terms and Conditions at any time at http://www.cream-creator.de/agb.html. Past orders can be viewed in your customer account under “My Account → My Orders”.
§3 Prices, Shipping Costs, Payment, Due Date
(1) The listed prices include statutory VAT and other price components. Shipping costs may be added.
(2) Payment methods: advance payment, PayPal, and credit card (Visa).
(3) If the consumer chooses advance payment, they are obliged to pay the purchase price immediately after contract conclusion.
§4 Delivery
(1) Unless clearly stated otherwise in the product description, all items offered are ready for dispatch immediately. Delivery is made within 5 working days. For advance payment, the delivery period starts the day after the payment order is issued to the bank. For all other payment methods, it starts the day after contract conclusion. If the end of the period falls on a Saturday, Sunday, or public holiday at the delivery location, the period ends on the next working day.
(2) The risk of accidental loss and deterioration of the goods passes to the buyer only upon handover, even in the case of a sale by dispatch.
§5 Retention of Title
We retain ownership of the goods until full payment has been made.
§6 Right of Withdrawal for Consumers
Right of Withdrawal
Consumers have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day you or a third party named by you (not the carrier) have taken possession of the goods.

with a clear declaration (e.g., letter, fax, or email) of your decision to withdraw from the contract. You may use the attached model withdrawal form, which is not mandatory.
Consequences of Withdrawal
If you withdraw from this contract, we will refund all payments received from you, including delivery costs (excluding additional costs arising if you chose a delivery method other than the least expensive standard delivery offered), promptly and no later than fourteen days from the date we receive notice of your withdrawal.
The refund will be made using the same payment method you used in the original transaction, unless expressly agreed otherwise. You will not be charged any fees for the refund.
We may withhold the refund until we have received the returned goods or you have provided proof that you returned them, whichever is earlier.
You must return or hand over the goods to us promptly and in any event no later than fourteen days from the day you notified us of the withdrawal. The deadline is met if you send the goods before the period of fourteen days has expired.
You bear the direct cost of returning the goods.
